GENERAL TERMS OF USE

Language-swap.com is a community site for language learning based on new technologies and the principles of sharing and conviviality. Users can practise and learn languages ​​for free, exchanging ideas on forums or taking part in online chats or quizzes.

In addition, they can take out a PREMIUM subscription, which entitles them to take part in Video chats: videoconferences to converse live with several others members, or one-on-one sessions with a teacher (one of the Social teachers). Payment for the PREMIUM subscription and for sessions with social teachers is made by PayPal.

THE RIGHT TO PRIVACY AND THE PROTECTION OF PERSONAL IMAGES

In accordance with the individual’s privacy rights regarding his/her published images, Language-swap.com prohibits the recording of video exchanges between the trainee(s) and the Social teacher during all video chats.

LIABILITY

Language-swap.com does everything in its power to check the record of each teaching candidate in detail before accepting his/her application to teach on our site.
However, Language-swap.com cannot be held liable for any consequences, either direct or indirect, of arranging to set up contacts between site users, or between users and teachers.
Language-swap.com can thus in no event be held liable for any inconvenience or damages occurring before, during or after the exchanges, conversations or lessons which take place on the site.

COOKIES

COMMENTS

The comments posted by users of Language-swap.com on its pages, such as forums, online chats and quiz pages, will be systematically moderated if they are offensive or if they infringe the law and ethical codes of conduct, particularly in terms of:

• Racist or offensive remarks
• The publication of obscene or pornographic images
• The commerce of weapons, drugs and like products
• Conversations about worship and religions

SHARING COURSE FEES:

With the tuition fee system, save up to 85% by sharing tuition fees with other people.

Book a course (see teacher profiles) or a course pack (click on course purchase from 4.4 € / h) and invite or wait for others to complete the group. As soon as it is complete (2 people for duo packs for example), you are notified by email of possible dates of courses with one of our social teachers.

You only pay the amount you have to pay. For example, if the price of the course is set at € 30, and the teacher accepts 5 students in his session, you will only pay € 6.



COURSE RESERVATION AND LEARNER GROUP TRAINING

There are two main ways to book a course either by buying retail courses on the teacher profile or buying a pack. So, depending on the case you:

• click on the teacher profile to book a class. Look in the different profiles for those who have already scheduled sessions; and you will choose based on the profiles, the price and the date, the time and number of students accepted in this session

• can book a lesson pack. To do this, click on '' purchase courses from 4.4 € / h '' and invite or wait for others to complete the group. As soon as it is complete (2 people for duo packs for example), you are notified by email of possible dates of courses with one of our social teachers.


• If you are interested in the profile of a teacher, even though the teacher has not yet scheduled a class, contact him via the "send a message" button to ask him / her to create and allow you to book his course. But this last option remains marginal.



Whatever the case, to book, choose according to the number of students accepted to a course, the formula that suits you best. You have the choice to follow an individual video chat session or to share the session with others.

If you are the first to book this course and you choose a course to several, others will come and complete it to allow you to share the costs.

No problem, if the number of students required is not reached, the course will be canceled and you will be fully refunded.

TERMS OF PAYMENT OF COURSE FEES

Payments are made by PayPal or bank cards.

The trainee agrees to pay:

• only the total price of the coaching session for an individual course

• or the share of the total that it is his responsibility to pay, in proportion to the number of people in his group. The group can be composed of up to 5 users in the same video chat session animated by a social teacher.



DURATION OF COURSES

The hours of the mentoring sessions are set freely by the social teacher, in one hour increments. He can cancel his lessons (see withdrawal period) if he has no session (s) in view reserved by users.

The times and dates of the lesson pack sessions are also fixed in one-hour increments and by mutual agreement between the social teacher and Language-Swap and are communicated to the trainees.

OBLIGATIONS OF THE SOCIAL TEACHER AND TERMS OF PERFORMANCE

All "social teachers" (teachers or independent trainers) are required, except in case of force majeure (death, illness, accident ...), strictly respect the date and time of the sessions they have programmed, under pain a penalty of 25%, to retain the price they set for this session. If the cancellation concerns a course ordered from one of our packs, this course is lost and due by the teacher.

Providers must privilege the practice.

The administrative and fiscal declaration of payments received from users is the responsibility of the social teachers.

WITHDRAWAL PERIOD

• A social teacher can not cancel his course if it has already been booked by users, except in case of force majeure (death, illness, accident ...).

• A social teacher can cancel his class before he is booked by a user.

• A social teacher can not cancel a class before 15 minutes of waiting and if no user appears in the video chat room

• A social teacher can cancel his class after 15 minutes of waiting if no user who booked the session appeared in the video chat room.

If it is a session with a single user, the social teacher receives 55% of the price he set after deducting the first installment of trainee-provider placement fees valued at 20% and a penalty of 25%. %.

In this case, the course is reprogrammed free of charge for the trainee.

• But in the case where there are several trainees in a session, if only one of the trainees is present, the course can be done and will be paid to the social teacher. Absentees automatically lose this course.

• In the case of a pack with several hours of lessons and paid by several trainees, courses are held if at least one trainee is present at the session and benefits are paid to the social teacher and not reimbursed to absentees.

• Also, if the pack is booked and paid by a single trainee, then the course is lost in case of absence or delay of 15 minutes, except in cases of force majeure or if the social teacher is willing to grant him a new session.

• Users who have booked a class or mentorship session can also cancel the class if the social teacher is at least 15 minutes late. The course is not refunded and is reprogrammed on a date to be communicated to the trainees.

• The provider is asked to give us information related to his absences, those of trainees, and the difficulties he / she encountered within 48 hours and to give us his new availability so that we can organize a new session with the trainees if the teacher created the course.



DATE AND TIME OF HOLDING VIDEO CHAT SESSIONS WITH SOCIAL TEACHER

• If it is the social teacher who created the course, the dates and times of the discussion sessions are freely determined by him and are visible on the platform www.language-swap.com.

• If the trainee buys one of our course packs, then the dates and times of the sessions are agreed between the social teacher and Language-Swap and communicated to the trainees.


SCHOOL E-TWINNING - TWINNING SCHOOLS

Language-swap offers schools, training centers the possibility of staying in constant contact with their partners via a twinning system. Our e-twinning feature connects schools to promote the exchange of language skills in total immersion between students in partner schools.

TERMS OF PAYMENT OF SUBSCRIPTION FEES

Payments are made by PayPal or bank cards.

The '' customer '' agrees to pay alone, the entire fixed price of the subscription. He is free to buy one or more from one to 12 months of subscription.

DURATION OF SUBSCRIPTIONS

Subscriptions are of variable duration.

• For schools, they vary between 1 and 12 months

• For users, subscriptions range from one week to 12 months of subscription



CANCELLATION OF AN ORDER

Any subscriber has a withdrawal period of 14 days from the date of subscription.

Before this deadline, Nanta agrees to refund the subscription fees after deduction of bank charges.

After this period, the refund is no longer possible. Nanta can transfer your subscription to a date that suits you. Only one postponement is possible.

DATE AND TIME OF HOLDING VISUAL CONVERSATION SESSIONS

• Sessions between institutions

The dates and times of the conversation-speaking sessions are fixed by mutual agreement between the twinned institutions.

• Sessions between users

The dates and times of the conversation sessions are defined by mutual agreement between users. They can be instant or on appointment.

APPLICABLE LAW

These Terms of Use are governed by French law. Any dispute concerning the implementation or interpretation of these Terms of Use will be submitted to the Tribunal de Commerce de Paris.
